Residuary power is the power retained by a governmental authority after certain powers have been delegated to other authorities.

Residuary powers can be defined as the remaining powers, which are under the parliament in a federal state, such as India. There are some powers, which are shared by the government at center and the state, however residual powers are only exercised by the state government. At present, the role and function of residual powers is in a state of controversy.

A residuary power is a power which is retained by a governmental authority after certain powers have been delegated to other authorities. There are 3 lists according to which the government distributes its powers which are:
1)Union List

2)Concurrent List

3)State List.

These are the powers retained by a governmental authority after certain powers have been delegated to other authorities. 
Part XI of the Indian constitution defines the power distribution between the federal government (the Centre) and the States in India. This part is divided between legislative and administrative powers. The legislative section is divided into three lists: Union list, States list and Concurrent list.
