In some cases it may happen that the AP gets maximised and stays constant before falling down to the next level. However, meanwhile MP continues to fall and later, there comes a point where the two intersect. That is, even if the question does not exactly shows that AP = MP when AP is maximum, it may happen that the intersection lies between the 4th and 5th unit when AP continues to remain constant at 40.25 before falling to 40, and meanwhile MP falls from 41 to 39 and meets AP at 40.25 in between, thereby proving the condition.
