Q Mr Gautam Aacharya was a supreme court lawyer and had filed a case against the INDIAN AIRLINES for cancelling the scheduled flight to Gauhati and all the persons including him were stranded at the airport without provision of space for rest,or food etc some of the passengers were vomitting due to suffocation.

If you were one of the passengers where would you file a case for a compensation of ? 1.30 lakhs and what directions would you seek from the court as relief measures.

Dear Student,
Under Consumer Protection Act, 1986 cases where Compensation claimed is less than 20 Lakhs needed to be filed under District Forum. Therefore, as one of the passenger, we would file case for compensation of 1.30 lakhs under District forum. However, if not satisfied by the judgement of the same, can appeal in the State Commission within 30 Days of passing the judgement.

Relief measures from the court can be one or more of the following directions to the opposite party :-
a) Refund of price that was paid for the airline services.
b) Payment of compensation in cash for the loss or injury suffered.
c) Payment of an appropriate amount to be credited to Consumer Welfare Fund.
