"We accept a constitution made more than 50 years ago" Why?Give three reasons.

  1. The constitution does not reflect the views of its members alone .It expresses a broad consensus of its time.
  2. The second reason for accepting the constitution is that the constituent assembly represented the people of india.
  3. The assembly was dominated by the indian national congress, the party that led indias freedom struggle.
  4. The assembly represented the members from different language, castes, religions, classes and occupations.
  5. The constituent assembly worked in a systematic, open and consensual manner which gives the sancity to the constitution.

i) The Constitution does not reflect the views of its members alone. It expresses a broad consensus of its time.
ii) Over the last half a century, several groups have questioned some provisions of the Constitution. But no large social group or political party has ever questioned the legitimacy of the Constitution itself.
iii) The second reason for accepting the Constitution is that the Constituent Assembly represented the people of India. There was no universal adult franchise at that time. So the Constituent Assembly could not have been chosen directly by all the people of India. It was elected mainly by the members of the existing Provincial Legislatures. This ensured fair geographical share of members from all the regions of the country
iv) The Assembly represented members from different language groups, castes, classes, religions and occupations. Even if the Constituent Assembly was elected by universal adult franchise, its composition would not have been very different.

There are always two sides in of a coin. I feel that we should follow a part of the constitution written fifty years ago and not follow the rest of it. The part we should follow should be must be relevant now like:-
  1. Over the last half century several groups have not questioned the legitimacy of the constitution itself. It is an unusual achievement for the constitution.
  2. The constitution of India represents the people of India.
  3. The assembly was dominated by congress men, the party that led Indian freedom struggle. But congress itself included people with different thoughts and opinions.
  4. In social terms to the assembly included people from different groups, castes, classes, religion and occupation.
  5. The assembly worked in a systematic, open and consensual manner.
But there are some problems not recognized by the constitution like
  1. Reservation was thought to be eradicated within few years of constitutional independence. Whereas it has increased ever since.
  2. The laws are often violated they need to be made stricter.
  3. Most of the poor people are getting poorer and rich richer. There needs to be a balance made by the government in this economic difference.

The Constituent Assembly that wrote the Indian constitution had 299 members. The Assembly adopted the constitution on 26th November 1949 but it came into effect on 26th January 1950. (i) The Constitution does not reflect the views of its members alone, it expresses a board consensus of its time. The makers of our constitution comprised illustrious personalities, belonging to different communities, regions and political parties of India. (ii) The Constituent Assembly represented all different social groups irrespective of class, creed, status, gender and occupations. There was no adult franchise, at that time. Even if the Constituent Assembly was elected by universal adult franchise, its composition would not have been very different. (iii) In some countries, the Constitution exists as a mere piece of paper, no one follows it. But in our country, no large social group or political party has ever questioned the legitimacy of the Constitution itself. This is an unusual achievement for any Constitution. (iv) The manner in which the Constituent Assembly worked gives sanctity to the Constitution. They worked in a systemtic, open and consensual manner. (v) A Drafting Committee chaired by Dr BR Ambedkar prepared a draft constitution for discussion. Several rounds of thorough discussion took place and more than two thousand amendments were considered. (vi) Every document presented and every word spoken in the Constituent Assembly has  been recorded and preserved. These are called 'Constituent Assembly Debates' and these are printed in 12 bulky volumes. These debates provide the rationale behind every position to the Constitution. There are used to interpret the meaning of the Constitution.

The first reason why we accept a constitution which is made more than fifty year ago is because
1) the constituent assembly represent the people. it is not elected by the people but  it has so many people of different cast, language, region, gender and so on. so they have different idea. so the assembly represent the people of our country

2) the constituent assembly work in a systamatic manner, open and consensual manner

3) the consituent assembly  assembly which drafted our constitution does not reflect the views of the members but the whole country.

The Constitution does not reflect the views of its members alone. It expresses a broad consensus of its time. Many countries of the world have had to rewrite their Constitution afresh because the basic rules were not accepted by all major social groups or political parties.

Over the last half a century, several groups have questioned some provisions of the Constitution. But no large social group or political party has ever questioned the legitimacy of the Constitution itself. This is an unusual achievement for any constitution. The second reason for accepting the Constitution is that the Constituent Assembly represented the people of India. There was no universal adult franchise at that time. So, the Constituent Assembly could not have been chosen directly by all the people of India.

The way in which the Constituent Assembly worked gives sanctity to the Constitution. The Constituent Assembly worked in a systematic, open, and consensual manner. First, some basic principles were decided and agreed upon. Then a Drafting Committee chaired by Dr. B.R. Ambedkar prepared a draft constitution for discussion. Several rounds of thorough discussion took place on the Draft Constitution, clause by clause. More than two thousand amendments were considered.

Every document presented, and every word spoken in the Constituent Assembly has been recorded and preserved. These are called ‘Constituent Assembly Debates’. These debates provide the rationale behind every provision of the Constitution. These are used to interpret the meaning of the Constitution.
