the degree of a differential equation is the degree of the highest order derivative, when differential coefficients are made free from radicals and fractions.

therefore in the eq(1):  the order of highest order derivative is 2. thus order of equation is 2.

degree of the highest order derivative is 1. thus degree of eq(1) is 1.
