Role and functions of police , public proscecutor, judge, defence lawyer

a.  The police - is involved in maintaining law and order .It is involved in an investigation .It is engaged in recording statements of witnesses and collecting different kinds of evidence.Police can make an arrest only  if it finds  some evidence to  connect the accused  with the crime from the statements of witnesses, circumstances  or other material  to support the arrest .

b. Public Prosecutor- Any act of crime is considered to be anti-social and against the interests of the general public. Our system of Justice not only has to ensure fair trial but also has to protect rights, freedoms of the society at large and  protect the community from crime, from anti social elements. Therefore, Public Prosecutors are appointed to represent not only the case of victims but the society at large. They are appointed to represent the general interest of the community. The Public Prosecutor fights for victim on behalf of the community. He presents witnesses and evidences.

c. The judge is like an umpire in a game and conducts the trial impartially and in an open manner. The judge hears all the witnesses and any other evidence presented by the prosecution and the defence. The judge decides whether the accused person is guilty or innocent on the basis of the evidence presented and in accordance with the law. If the accused is convicted, then the judge pronounces the sentence.He may send the person to jail or impose a fine or both,depending on what the law prescribes.

d. Defence lawyer- He /she fights the case on behalf of the accused/ defendant, The defence lawyer represents the case of the person accused in a crime in the court. This is to ensure fair trial to the person . He presents counter evidence and witnesses,
It also ensures that Judgement is to be based on the evidences collected and not according to whims and fancies of a judge.The defence lawyer presents rebuttals to prosecutor's claim and ensures that rights of the defendant is not violated.
