what is fair trial

A fair trial is the one that preserves the ethos of equality and justice. A fair trial ensures that the guilty gets punishment only according to the scale of the crime and nothing else. On the other hand, it also ensures that nobody is punished simply because they belong to the marginalized sections of society.

In India, Article 21 of the Constitution that guarantees the Right to Life states that a person’s life or liberty can be taken away only by following a reasonable and just legal procedure. A fair trial ensures that Article 21 of the Constitution is upheld.
