- Firstly, the accused is given a copy of the charge sheet and all other evidence that the prosecution presented against him/ her
- The offense must be defined as a crime in the law.
- The trial must be held in an open court, in public view. The relatives may be allowed to attend the court hearings.
- The trial must be held in the presence of the accused.
- The accused is defended by a lawyer.
- The lawyer of the accused must be given an opportunity to cross-examine all the prosecution witnesses.
- The judge assumed the accused to be innocent till the crime is proved
- The judge should remain impartial.
