Domestic violence is defined as the conduct that:
  • Habitually assaults an aggrieved person
  • Forces the aggrieved person to lead an immoral life
  • Harms or injures the aggrieved person
The Protection of Women from Domestic Violence Act 2005 has been envisaged to protect women who are victims of domestic violence. This Act is an improvement upon Section 498A of the Indian Penal Code that dealt with domestic violence earlier.
  • The Protection of Women from Domestic Violence Act 2005 offers woman’s right to secure housing. Any victim of domestic violence has the right to reside in the matrimonial or shared household even though she may not have any title over such property
  • The Act offers the right to reside in a shared household with the husband. The husband cannot evict his wife from such household even if the wife does not hold any title over such a property
  • The Act powers the court to pass protection orders for such a victim
  • It also offers Protection Officers and NGOs to provide assistance to the victim
  • The Act offers protection against economic abuse and any woman, who is victim of domestic violence can press for economic entitlements that she requires out of necessity
