Why is it important for the judiciary to be independent? What provisions have been made by the constitution of India to make the judiciary independent?

It is important for the judiciary to be independent to ensure that the executive and the legislature cannot abuse their powers. One of the main responsibilities of the judiciary is to ensure that the legislature and the executive operate according to the constitution. They must not become a dictatorship and the fundamental rights of citizens need to be protected. This can be done by the judiciary only if it is independent of the legislature and the judiciary.

The provisions made under the constitution to ensure independence of judiciary are

1. Judges cannot be dismissed arbitrarily by the government. Instead, judges of the supreme court and high courts can only be dismissed after a complicated impeachment procedure.

2. Judges of the supreme court and high courts can only be appointed on the recommendation of the supreme court collegium. This ensures that judicial appointments are free of government interference.

3. The judiciary can punish members of the executive for contempt of court if the executive disobeys its orders.
